Terms of Service

TurnPals is a product of Tobistech Ltd, a company registered in England and Wales. These Terms of Service (the “Terms”) are a legal agreement between you and Tobistech Ltd (“TurnPals”, “we”, “us” or “our”) and govern your access to and use of the TurnPals mobile applications, website and related services (together, the “Service”). Please read them carefully. By creating an account, joining the waitlist, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1.Eligibility & age

TurnPals is intended for adults aged 18 and over. You must be at least 18 years old (or the age of majority in your country, if higher) to create an account or use the Service. By using the Service you confirm that you meet this age requirement, that you have the legal capacity to enter into these Terms, and that you are not located in, or a resident of, a country where the Service - or features such as coin staking - is prohibited. We may ask you to verify your age and may suspend or close accounts we reasonably believe belong to anyone under 18.

2.Your account

  • You are responsible for keeping your login details secure and for all activity under your account.
  • Provide accurate information and keep it up to date. One person may not maintain multiple accounts to gain an unfair advantage or abuse rewards.
  • Notify us promptly at contact@tobistech.co.uk if you believe your account has been compromised.
  • Accounts are personal to you and may not be sold, rented, shared or transferred.

3.Licence to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and use the Service for your own non-commercial entertainment. All rights not expressly granted are reserved. You must not copy, modify, reverse-engineer, decompile, scrape, or create derivative works from the Service except to the extent this restriction is prohibited by law.

4.Acceptable use

You agree not to, and not to attempt to:

  • cheat, use bots, automation, memory editors, unauthorised third-party software, or otherwise manipulate matches, ratings, matchmaking, coins or rewards;
  • collude, match-fix, or intentionally lose to transfer coins or manipulate leaderboards or tournaments;
  • harass, bully, threaten, defraud, impersonate, or infringe the rights of other players;
  • post or transmit content that is illegal, hateful, sexual involving minors, violent, defamatory, or that violates any law;
  • disrupt, overload, probe or attempt to gain unauthorised access to the Service, other accounts, or our systems;
  • create accounts by automated means, or evade bans, suspensions or in-game restrictions;
  • use the Service to launder value, commit fraud, or infringe intellectual-property or privacy rights.

We may investigate suspected violations and take any action we consider appropriate, including removing content, adjusting balances obtained through abuse, restricting features, or suspending or terminating accounts.

5.Virtual coins & items

The Service includes virtual currency (“Coins”) and virtual goods such as cosmetics, board skins, avatar frames, gifts, consumables and passes (“Virtual Items”). You may earn Coins by playing (daily rewards, missions, puzzles, wins and events) or buy them through the app stores.

Coins and Virtual Items have no monetary value. They are a limited, personal, revocable licence to use features within the Service - not your property, not real money, and not a bank deposit or stored-value instrument. They cannot be redeemed, exchanged or “cashed out” for real money, and cannot be sold, traded or transferred outside the Service except through features we expressly provide (such as in-game gifting).
  • Coins and Virtual Items are generally non-refundable once delivered, except where a refund is required by law or granted through the app store (see section 7).
  • We may create, manage, modify, price, and remove Coins and Virtual Items, and may set limits on earning, holding, staking or spending them, at our discretion.
  • We may adjust or remove balances that were obtained through error, fraud, exploits, chargebacks or breach of these Terms.
  • Unspent Coins and Virtual Items are forfeited if your account is closed or terminated, and on discontinuation of the Service (see section 12).

6.Coin stakes & “no gambling”

Some matches let players stake Coins, with the winner receiving the pot. This is a feature of gameplay for entertainment only.

  • Coins are not money and have no cash value, and prizes consist solely of Coins and Virtual Items that cannot be cashed out. The Service does not offer any opportunity to win real money or anything of real-world monetary value.
  • Because there is no real-world prize and nothing of monetary value can be won or withdrawn, staking Coins is not gambling, betting or a lottery.
  • You are responsible for ensuring your use of staking and similar features is permitted where you live. If such features are not permitted in your country, you must not use them.

7.Purchases & subscriptions

Coin packs and the optional premium subscription are sold and processed by the Apple App Store or Google Play (and, where applicable, our payments provider RevenueCat). Your purchase is also subject to the relevant store’s terms and payment policies. Prices are shown in the app and may vary by region, currency, taxes and store account, and may change over time.

Auto-renewing subscriptions

  • The premium subscription renews automatically for the chosen period until you cancel. Your store account is charged at each renewal unless you turn off auto-renew at least 24 hours before the current period ends.
  • Manage or cancel your subscription in your Apple or Google account settings - not by deleting the app. Cancelling stops future renewals; the current paid period continues until it expires.

Refunds & withdrawal

  • Refund requests are handled by the app store under its policies. Request refunds directly through your Apple or Google account.
  • Digital content and Coins are delivered immediately. Where you have a statutory right of withdrawal (for example, the 14-day right in the EU/UK), you acknowledge and request that supply begins immediately, and you accept that this right is lost once delivery/consumption has begun, to the extent permitted by law. This does not affect mandatory consumer rights that cannot be waived.

8.Rewards, waitlist & referrals

  • Promotional rewards - including waitlist bonuses, founder benefits, referral rewards, daily rewards, missions, streaks, season passes and events - are provided at our discretion, have no cash value, and may be changed, limited or withdrawn.
  • Referral and waitlist rewards are intended for genuine new players. We may withhold, reverse or void rewards obtained through fake, duplicate or abusive signups, self-referral, or other manipulation.
  • When you refer someone and both accounts are active, we may connect you as in-game pals so you can play together.

9.Voice, chat & your content

The Service includes real-time voice rooms, chat, usernames, avatars, and other content you create or share (“Your Content”). You are solely responsible for Your Content and must have the rights to share it.

  • You must not share content that is unlawful, hateful, harassing, sexually explicit, that endangers minors, that infringes others’ rights, or that violates section 4.
  • You grant us a worldwide, non-exclusive, royalty-free licence to host, transmit, display and process Your Content solely to operate, moderate and improve the Service.
  • Live voice is transmitted between participants to enable the room; anyone in a room can hear you. Do not share sensitive personal information in voice or chat.
  • We may, but are not obliged to, monitor, moderate, or remove content and may suspend features or accounts to keep players safe. You can report players and content in-app or via Support.

10.Intellectual property

The Service and everything in it other than Your Content - including the software, game designs, boards, artwork, logos, “TurnPals” branding, text, sounds and animations - is owned by Tobistech Ltd or its licensors and is protected by intellectual-property laws. The names of classic games such as chess, draughts, ludo and tic-tac-toe describe gameplay and are not claimed as our trademarks. You receive only the limited licence in section 3; you get no ownership of any part of the Service or of any Coins or Virtual Items.

11.Third-party services

The Service relies on third parties - including the Apple App Store and Google Play, payment and subscription processing, real-time voice and messaging infrastructure, advertising, push notifications, email delivery, analytics and hosting. Your use of those features may also be subject to the relevant third party’s terms, and we are not responsible for third-party services. See our Privacy Policy for how data is shared with them.

12.Suspension & termination

  • You may stop using the Service and delete your account at any time (in-app account settings, or contact Support).
  • We may suspend or terminate your access, remove content, or reset balances obtained through abuse, if you breach these Terms, if required by law or an app store, or to protect players or the Service.
  • We may modify, suspend or discontinue any part of the Service. On termination or discontinuation, your licence ends and any Coins and Virtual Items are forfeited, except where a refund is required by law.
  • Sections that by their nature should survive termination (including 5, 10, 13, 14, 15, 16 and 18) will survive.

13.Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or free of harmful components, or that matchmaking, ratings, or opponents will always be available. Nothing in these Terms excludes or limits rights you have as a consumer that cannot be excluded or limited under applicable law.

14.Limitation of liability

To the fullest extent permitted by law, Tobistech Ltd and its officers, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, Coins or Virtual Items, arising from or related to your use of (or inability to use) the Service. To the fullest extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you, and nothing here limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud).

15.Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Tobistech Ltd from any claims, losses, liabilities and reasonable expenses (including legal fees) arising out of your breach of these Terms, your misuse of the Service, or Your Content.

16.Governing law & disputes

These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules, and you and we submit to the exclusive jurisdiction of the courts of England and Wales to resolve any dispute, except that this does not deprive you of the protection of mandatory consumer-protection laws of your country of residence, and you may also be entitled to bring proceedings in your local courts. We encourage you to contact us first at contact@tobistech.co.uk so we can try to resolve the matter informally.

17.Changes

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, in-app or by email) and update the “Last updated” date above. Changes take effect when posted unless stated otherwise. Continuing to use the Service after changes take effect means you accept the updated Terms.

18.General

  • Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is found unenforceable, the rest remains in effect.
  • No waiver. Our failure to enforce a provision is not a waiver of it.
  • Assignment. You may not assign these Terms; we may assign them to an affiliate or successor.
  • International use. We offer the Service to players around the world, but it may not be available or appropriate in every country. You are responsible for complying with the laws that apply where you live and access the Service, and you must not use it, or any feature such as coin staking, where doing so would be unlawful. We may restrict availability of the Service or particular features in certain regions.
  • Language. These Terms are provided in English. Any translation is for convenience only; if there is a conflict, the English version prevails, except where local law requires otherwise.
  • Apple/Google. If you use the app via the Apple App Store or Google Play, these Terms are between you and us, not the store; the store is not responsible for the Service, and its own terms also apply.
